CHAPTER X - ORGANISATION

Article 10 - 1
The elected officers of this Federation shall be categorized into :-

Section 1 EXECUTIVE COUNCIL
The Executive Council of the federation shall be the overall ruling authority of the Federation. The executive Council members shall comprise of nominated members from the respective Ordinary Members.

Section 2a DISCIPLINARY COMMITTEE

The Disciplinary Committee is responsible to research on all cases calling for Disciplinary action and has the authority to call upon the offending member to attend a Hearing should the need arises. This covers malpractices, unethical practices, misconduct, non - fulfillment of contact, cheating, embezzlement and any other peculiar practices out of the norm by members and when alleged by any one party, the Disciplinary Committee shall immediately institute investigation including employing of assistance form professionals subject to the approval of two - third (2/3) of the Executive Council should the services of the latter be required.

Section 2b
The Disciplinary Committee shall comprise of not less than three (3) Council Members duly elected by the Council with one being elected to be the Chairman of the said Committee.

Section 2c
Should the investigation prove against the offending party, the Disciplinary Committee must call for a Hearing within thirty (30) days from the day the committee decided that the investigation has proven against the offending party.

Section 2d

The whole Disciplinary Committee must be present at a Hearing.

Section 2e
A notice, in writing, must be given to the offending party by the Committee Chairman or the Committee member of the Disciplinary Committee so appointed as the Disciplinary Committee's Hon. Secretary. This said notice must be sent fourteen (14) days prior to the date of the said Hearing to the offending party and the offending member must be mailed by A.R. Registered Mail.

Section 2f
The Disciplinary Committee after the Hearing may have the discretion to make the following decision :
  1. dismiss the complaint against the offending member ; or
  2. Caution the offending member, in writing, within fourteen (14) days after the said Hearing and mailed by A.R.Registered Mail to the offending member ; or
  3. Institute By-Law 7-9 against the offending member.
Section 2g
Should any offending member fail to attend the Hearing, the member automatically, forfeits the right of the Disciplinary Committee shall be final.

Section 2h
Should any offending member, after having attended the Hearing in front of the Disciplinary Committee, feels dissatisfied with the decision of the said Committee, he may appeal, in writing, to the Council within seven (7) days from the date of receipt of the decision of the Committee.

Section 2i
In case of appeal, notice for appeal and for the Appeal Hearing shall follow that of section 6 & 7 of By-Law 7-9 of this Constitution.

Section 2j
The Appeal panel, after the Appeal Hearing, may have the discretion to :
  1. uphold the original decision of the Committee; or
  2. increase or decrease the penalty as listed in section 2f of Article 10-1 this Constitution and in section 3 of Article 7-9 of this Constitution and in section 3 of Article 7-9 of this Constitution. The rest of this Appeal procedure comply with the rest of section 8 of By-Law 7-9 of this Constitution.
 
CHAPTER XI - OFFICERS

Article 11-1 COUNCIL MEMBERS :

Section 1
The Executive Council shall comprise of the following elected members from the respective nominations from members with each Ordinary Member being represented by a maximum of six (6) nominees in the Executive Council. a. President b. Vice - President c. Hon. Secretary General d. Hon. Treasurer General e. The remaining accredited representatives will automatically, become Council Members.

Section 2 PROVISO :
The Council Members must be above the age of twenty-one (21) Years and must be Malaysian citizens except with the approval of Societies and / or the Ministry of Home Affairs of Malaysia.


Article 11-2 ELECTED :

Section 1a
The President of the Executive Council shall be elected at a General Meeting of the Federation. No member shall be eligible for election as President unless he has served a minimum period of a term on the Executive Council immediately prior to such Biennial General or General Meeting of the Federation held for the purpose of such election in case of such a vacancy arising and the person nominated for election must be an office - bearer of an Ordinary Member's Organization.

Section 1b PROVISO
The vice-President, the Hon. Secretary General and the Hon. Treasurer General of the Executive Council shall not be from the same Ordinary Membership.

Section 1c
The Council Members making up the rest of the Council shall be the nominees of the respective Ordinary Members.

Section 1d
The Council's elected representative shall be elected at the Biennial General Meeting of the Federation.


Article 11-3 PERIOD OF OFFICE :

Section 1
The Executive Council and its Committees shall retire at each Biennial General Meeting and retiring Council members shall be eligible for re-election and / or re-nomination insofar as they are fully qualified in accordance to this Constitution of the Federation.

Section 2 PROVISO
No member who is in default of payment of his subscription shall be eligible to be nominated for election or be elected or nominated to the Council.


Article 11-4 NOMINATIONS :

Nominations for the president, Vice- President, the Hon. Secretary General and the Council's hon. Treasurer General positions shall be in the nomination form (APPENDIX 'C') prescribed by the Council and shall be duly filled up proposed and seconded and by two (2) Ordinary members in good standing.


Article 11-5 VACANCIES

Section 1
Where there are no nominations for the Presidency, Vice - Presidency, Hon. Secretary General and Hon. Treasurer General at the time of election at the Biennial General Meeting, the Meeting shall fill such vacancies from amongst the members present at the Meeting.

Section 2
in the case of a vacancy occurring on the Council for any reason whatsoever, the Council shall have the power to co-opt a member of their respective ordinary member from which the vacancy insofar as the vacancy does not affect Section 1a, 1b, 1c and 1d of Article 11-1 of this Constitution. Such co-opted member shall serve for the balance of the term of office that original Council member would have normally served.
