CHAPTER I - NAME OF FEDERATION

Article 1-1: NAME
This Federation shall be known as the Persekutuan Penghantar Fret Malaysia ( Federation of Malaysian Freight Forwarders ) and hereinafter in this Constitution shall be referred to as 'The Federation'.

Article 1-2: ABBREVIATION
FMFF shall be recognized as the official abbreviation for the Federation.

 
CHAPTER II - REGISTERED PREMISES

BY - Law 2-1
The registered premises of the Federation shall be at 18, Jalan 1/64, Off Jalan Kolam Air / Jalan Ipoh, 51200 Kuala Lumpur or any other place as may be decided by the Council within the approval of the Registrar of Societies and the postal address of the Federation shall be at 18, Jalan 1/64, Off Jalan Kolam Air / Jalan Ipoh, 51200 Kuala Lumpur or any other place as may be decided by the Council within the approval of the Registrar of Societies.
 
 
CHAPTER III - INTERPRTATION

BY - Law 3-1
In this Constitution lest any repugnance of interpretation:

Section 1
'Accredited Representative ( S )' mean ( S ) any person ( S ) appointed In writing by their firm, who are members of the Association, to sit in the Association, to sit in the Association.

Section 2
'Air / Air Freight Forwarder' means any firm actively indulged in the Forwarding of Freight by means of Air transportation.

Section 3
Airline Ground Handling Agent' means any firm operating a ground handling services for airlines.

Section 4
'Annual' means once a year.

Section 5
'Customs Broker' means person ( S ) or firm ( S ) that are appointed by the Royal Malaysian Customs Department to act as a Freight Forwarder and / or agent to act on matters and process involving the laws relating to Customs & Excise.

Section 6
'Biennial' means once in two years

Section 7
'Calendar Year' means the 1st of January to 31st December.

Section 8
'Carrier' means any firm operating transport equipment to transport cargo and will be differentiated by pre-fixes 'Air' , 'Rail' , 'Road' , or 'Sea' according to their different modes of operating.

Section 9
'Client / Customer' means any person ( S ) or firms ( S ) that appoint (S) a freight forwarder to act on his / their behalf.

Section 10
'Combined Transport / Intermodal Transport' means where more that one mode of transport is used in the movement of cargo / freight from ex-works till in house delivery.

Section 11
Committee' means the committees set-up within this Constitution.

Section 12

'Committee , Adhoc' means any other Committee (S) set-up by the Council within this Constitution.

Section 13
'Communication Address (es)' means the mailing address, telex and / or telefacsimile numbers ass is registered with the Federation.

Section 14
'Conference' means e.g. the Far Eastern Freight Conference (FEFC)' when mentioned in relation to sea freight forwarding but if pre-fixed appropriately, it shall then mean accordingly whether in relation to sea freight forwarding or other modes of freight forwarding.

Section 15
'Consignee' means persons (S) or firm (S) to whom or which goods are consigned to.

Section 16
'Constitution' means the Constitution of the Federation as contained or with future amendments and additions there to.

Section 17

'Council' means the Executive Council of the federation.

Section 18
'Councilors' means members of the Council.

Section 19
'Correspondences' means any media of correspondence which include cable, mail, telephone, telex and telefacsimile.

Section 20
'Customs' means a custom & Excise Authority.

Section 21
'Federation' means the Persekutuan Penghantar Fret Malaysia.

Section 22
'FEFC' means the Far Eastern Freight Conference.

Section 23

'FIATA' means The International Federation of Freight forwarders (Federation International des Associations de Transitaires et Assimiles.

Section 24
'Firm' , means a business Concern.

Section 25
'Forwarders' means any firm actively indulged in freight forwarding and the movement of freight from to place.

Section 26
'General Body' means the membership of the Federation.

Section 27
'Good Standing' means the member is without debt to or default in the Federation.

Section 28
'Government Authorit (y) ies' means Government Body with the power to enforce obedience.

Section 29
'He' , 'His' , 'It' , is to denote all genders including firms and the singular also denote the plural and vice - versa.

Section 30
'In writing' , 'Written' means reproduced words in Bahasa Malaysia and/or English.

Section 31
'Industry' means the freight forwarding business as a whole.

Section 32

'International' means the International Air Transport Association.

Section 33

'IATA' means the International Air Transport Association.

Section 34
'Organization' means any Association, Society or Establishment registered with the Registrar of Society of Malaysia.

Section 35

'Outside' means person (S) and firm (S) out of the Federation.

Section 36
'Outsider' means a non-signee of any conference resolution when referred to in relation to see freight forwarding.

Section 37
'Port Authority' means any establishment or firm that operates a Terminal for the landing of cargo by seagoing vessels complete with all required services.

Section 38
'Railway Authority' means any establishment or firm that operates a Terminal for the loading and unloading of cargo by trains complete with all required services and manages a railway network I Malaysia.

Section 39
'Rail Forwarder' means any firm actively indulged in the forwarding of freight by means of rail transportation.

Section 40
'Register' means the register of members of the Federation.

Section 41
'Road Forwarder' means any firm actively indulged in the forwarding of freight by means of road transportation.

Section 42
'Road Transport Authority' means any establishment, Authority or firm that enforces obedience on the operation of road transportation in Malaysia.

Section 43
Sea / Sea Freight Forwarder' means any firm actively indulged in the forwarding of freight by means of sea transportation.

Section 44

'Shipper' means any person (S) or firm (S) who originate (S) the cargo for sending to a consignee.

Section 45
'Terminal Operator' means any firm operating a transport terminal for carriers' transportation equipment to load and unload cargo and shall be differentiated by pre-fixes in indicating their respective modes of transport handling.


By-Law 3-2

In case of repugnance, the council shall interpret the Rules of the Federation, and where the constitution is silent, to determine the point expect where they are contrary to or inconsistent with the policy laid down by the General Body, the decision of the Council shall be binding on all members of the Federation unless and until countermanded by a resolution of a General Meeting.
